CARGO AIR SHIPMENT AND CUSTOMS CLEARANCE

Steps to be taken for customs clearance in Sheremetievo

Obviously, customs clearance is handled at the customs, but items are to be agreed at three higher instutia consequently: Customs, Regional Customs Committee, State Customs Committee. Sheremetievo Customs is directly subordinated to the Russian State Customs Committee. Sheremetievo Customs is empowered with much more commissions to settle points without passing them over to a higher Customs organization, but problems, that got no settlement, shall be resolved exactly at the State Customs Committee.

The Customs handling is divided in 5 stages:
1. Customs Declaration registration
2. Documentary control
3. Currency control
4. Customs fees payment control
5. Inspection and clearance of shipment

The airfreight customs clearance and release of air cargo is considered to be the final step within air delivery and is in contradiction to vehicle transportation.

After the Cargo Customs Declaration is submitted it shall be registered by assuming number. Registration of the Cargo Customs Declaration is carried out by the Customs Registration and Customs Control Department of the Sheremetievo Customs. Consequently Customs Registration and Customs Control Department shall realize documentary control over information stated in the Customs Declaration and the submitted papers attached to the Declaration.

We might underline the following functions among those realized by the Customs Registration and Customs Control Department:
- verification of the registration for the Foreign Trade Activities members and paying capacity of the latter;
- examination of the Cargo Customs Declaration;
- verification of the data stated in the Customs Declaration (information should be true and full);
- checking up the goods classification that should fully observe the classification stipulated in the Goods Harmonized System;
- money reservation of the Foreign Trade Activity member for customs duty payment;
- verification of submitted documents and information;
- the Customs Declaration data and information in the submitted papers to be brought into correlation

In case the Customs Registration and Customs Control Division is not empowered to settle some points, it shall pass over the Customs Declaration and other documents attached to the Customs functional sections for approval.

The main divisions of Sheremetievo Customs are:
1. Division of tariff and tariff–free handling – deals with points connected with goods classification stipulated in the Goods Harmonized System and also tariff-free measures for the foreign trade activity (license, certificate, letters of permition, etc)
2. Currency Control Division – deals with area connected with observation of currency legislation
3. Customs Duties Division – deals with all points connected with other duties announced, excluding clearance for free circulation and export.
4. Customs Inspection Division – points connected with free deliveries and further control rendered by the Foreign Trade Activity members after the goods were cleared.

Upon confirmation the Customs Registration and Customs Control Division shall make a decision on this or that point.

After registration and documents control approval, the Customs Registration and Customs Control Division shall render currency control. The points are approved by Currency Control Division and at the Customs Value Control Division.

Customs Value Control Division shall agree points derived from goods value announced for the customs and also shall specify goods values and customs payments.

Upon passing the Currency Control Division and the Documentary Control Division, the Customs Payment Division shall render currency control and withdraw Customs fees.

The Customs Duty Division shall agree all points derived from calculation and payments of customs duties, and offer preferential tariff and duties.

Customs Inspection Group shall examine cargo at the Final stage. Its task is to examine goods and their relevancy to the information stated in the Customs Declaration and in submitted papers, and customs clearance of the goods. Sometimes after the goods are examined it is needed to get the approval for clearance at the Department for Organization of Customs Registration and Customs Control.

IATA – INTERNATIONAL AIR TRANSPORT ASSOCIATION

The International Air Transport Association is an International Institution which regulates activities in the area of Air Carriers. The IATA was founded in 1945, its headquarters is in Montreal, Canada. The Association unites more than 270 air companies and thousands of cargo and touring agents worldwide. IATA membership is based on free will.
In particular, IATA efforts in the area of Air Cargo Shipment are aimed at:
1. Development and introduction of standards for Air cargo shipment.
2. Development and introduction of air shipment rules.
3. Development and introduction of safety regulations for air shipments.
4. Definition of cargo classes, including dangerous goods classification for air shipment.
5. Presentation of claims for air companies, airports, cargo agents and warehouses.
6. Adoption of general form for shipment papers – Air waybill.
7. Definition of rights and obligations for Air companies and agents.
8. Regulation of air shipment rates.

IATA publishes annual reference editions containing airfreight rates regulation world wide, flight safety, dangerous goods classification, etc.

No. 690-P of December 19,2003, JSC “Skyfor” was registered under No.2 in the Customs Registration List for Brokers acting within the Sheremetevo Customs Area.

Number of customs brokers might be reduced next year

Starting from January 2004 the life of customs brokers in Russia might become significantly complex, and some of them might cancel their business. The consequences might be caused by coming into force of the new Customs Rules which says that brokers should submit a certificate of customs fee guarantee for the amount of 50 mln rubles.

The brokers shall not have to acquire license for their activity issued by the State Customs Committee starting from 2004, their registration will become in the form of notify. But the work won’t become simple. According to Articles Nos. 140 and 339 of the new Customs Rules, the companies should provide a guarantee of 50 mln. rubles in the form of bank guarantee, property mortgage, letter of guarantee or money deposit in favor of the State Customs Committee. The companies, which have been working in the market already, can continue their work, but also in the event they submit the above sum.

The majority of Customs brokers accepted the project without enthusiasm. “Changes that occur in the Customs Rules will influence our work”-, comments “West-Consulting” Co., -“We are in this business for more than 5 years and work successfully. But 50 mln. rubles is a large sum.” Skyfor is of the same point of view: “Ministry of Finance tried not once to introduce the Rules that might ruin our business. However common sense wins usually, and necessary corrections have been introduced into the bill…”-says Mr.Valery Gorchakov, General Director of the Company. – “In any case we plan to continue our activity, though this law might be a significant step back in the whole business.”

Analysts share the opinion of the Market, they think that many companies, which are quite successful today, might not find the necessary amount or a guarantor. The brokers comment that as a result only 10-15 major companies will operate on the market (for the present there are more than one and a half thousand brokers). Then serious competition might be left behind. Companies, which will continue their business, will get the opportunity to dictate the price level and to define the service quality. The Analysts are of the opinion that the prices will raise along with.

The “United International Custom Warehouses Net” Corporation, which deals with consultations in the field of customs legislation, also believed that the fee demanded by the State Customs Committee is too large and cause brokers to leave the market. But the “United International Customs Warehouses Net” Corporation believes that 50-100 companies will still act on the market. They comment: “Possibly, this action is made to reduce the number of brokers so as it will be easier to provide control.”

The State Customs Committee refused to comment. The SCC press-service referred to the fact this is initiated by the State Duma and not by their Committee.
